精神损害赔偿浅论

随着人权保护理念的不断强化，社会对公民个体权利的日益尊重，近年来的司法实践尤其是侵权案件中精神损害赔偿诉求越来越多，然而有关精神损害赔偿的法律依据却十分单薄，不具明确性。针对这一现状，本文就精神损害赔偿的有关问题作了简要论述。

With the intensification of the mentality of human right protection and the social respect of civil individual rights, the lawsuit of compensation for moral loss is increasing in recent years in judicial practice. However, the legal basis concerning compensation for moral loss is very feeble and confusing. To counter this state, the paper gives brief discussion of some problems concerning the compensation for moral loss.
