| 摘 要： | WTO国际法律责任的范围通常是非溯及既往的,而"汽车皮革案"执行问题专家组将《补贴和反补贴措施协议》有关条款解释为实施了禁止性补贴的成员有责任溯及既往地撤销补贴。这一解释不能令人信服。对本案的深入分析认识对于中国处理有关补贴的争端及中国参加多边贸易谈判都具有借鉴意义。

| Abstract: | The scope of international legal responsibility in WTO is usually regarded as prospective,but the implementation panel of "Automotive Leather" case explained the related provision of Agreement on Subsidies and Countervailing Measures as having retrospective effect for the Member having used prohibited subsidy.Such an explanation is inconvincible.Intensive analysis of the case will be helpful to China in settlement of related subsidy cases and in the multilateral trade negotiation. |
