虚假广告罪的解读

摘    要:虚假广告犯罪在市场经济条件下日益蔓延。本文就虚假广告罪的概念、主体、客体、主观方面及客观方面进行解读,得出如下结论:立法上要明确界定虚假广告罪的概念,其罪的主体要增加到广告推荐者,并且在此罪的主观认定上实施严格责任。

Abstract:Nowadays the crime of false advertising is increasing rapidly in economic life of socialist market.The paper analyzes the concept,subject,object,subjective aspect and objective aspect of false advertising crime and comes to the following conclusions: the concept of the crime should be defined distinctly;the introducer of false advertisement should fall into the subject of the crime and breakers of law should hold strict liability.
