| 摘 要： | 我国是海洋大国,在陆地可利用面积逐年减少的今天,向海洋要资源,合理配置利用海域使用权已是必然。但是由于我国海域使用权的市场化经营实践时间较短,海域使用权在一级市场、二级市场中都存在着许多问题。因此,建立健全海域使用权流转的专门民事及配套法律法规,确立海域使用权在一、二级市场中合理流动的法律机制,从而保障海域使用权市场化经营的顺利发展。
