论犯罪未遂着手的认定

本文通过对大陆法系国家关于着手的学说介绍以及列举不同情况下实行着手问题的分析,应反对刑法理论研究过分精细化,反对对着手问题认定一味的追求具体模式的结论。主张在相对罪刑法定主义及各国不同刑事政策的指导之下,具体问题具体分析,摆脱僵化不切实际的模式枷锁,以几个重要的因素为实行行为着手判断的参考即可的观点。
