试论我国农村宅基地治理中的农民参与

宅基地问题一直是我国农村生产、生活中最复杂、最棘手的问题。政府有关部门在宅基地治理中习惯单向管制方式,加上各种因素的制约,尽管各类法律、法规或规章对农民参与有所规定,但农民参与的深度、广度都有待拓展。基于民主参与及政府善治理论,结合我国农村宅基地治理的实践,现阶段在扩大农民参与的路径选择时不仅要完善既有的听证会规则,还需关注非正式听证方式,建立意见回应机制。

On Peasants' Participation on the Governance of Rural Homestead in China

The problem of homestead is always the most complicated and difficult in the rural production and life in China.The relative department is used to one-way control in the governance of homestead.Restricted by all kinds of factors,through there are provisions for the peasants＇ participation in all sorts of law,regulations and rules,the depth and breadth need to be expanded.Based on democratic participation and government＇s governance,combined with the governance practice of rural homestead in China,it must not only perfect the established hearing rule,but pay attention to informal method of hearing and establish the mechanism of suggestion response in present path selection of broadening the peasants＇ participation.
