| 摘 要： | 反垄断法应有效地制约垄断企业滥用其具有的支配力量，其中反垄断法的适用问题直接牵涉到反垄断法的各方面效力范围，具有重要价值。垄断的认定应坚持行为主义模式而非结构主义模式；反垄断法应重点规范行政垄断而非经济垄断；反垄断法应允许必要的适用豁免；反垄断法可以被赋予适当的域外效力。

| Abstract: | The issue of the Application of Anti - Monopoly is of much importance for the reason that it is directly attached to the various force effectiveness of the act. The essay holds that the definition of monopoly should be defined to the mode of behavior rather than construction. Anti - Monopoly should lay emphasis on administrative trust rather than economic trust. The necessary release and moderate extra -territory is appreciated. |
