论法律人与经济人的共同性

在方法论角度上，经济学与法学都可以区分为理论研究和应用研究，理论研究可以进一步区分为精确取向的研究和经验取向的研究。精确取向研究中的法律人和经济人是个理论概念，他们的特性假设都是理性的，是利益最大化者，而在经验取向的研究中，他们的特征各有不同，且两种取向的结果不可互相验证。法律人概念在法技术上与法律权利、义务相关，由此亦可证明利益最大化假设的正当性。这样的法律人认识，有助于法学研究的深入和科学化。

On Legal Person and Economic Man Are Identical

In methodological perspective, economics and law can be divided into theoretical and applied research. Theoretical research can be furtherly divided into the precise orientation and experience orienta-tion. The legal person and economic man are theoretical concepts in precise orientation study, and their characteristics assumptions are rational, but their characteristics are different from each other in experi-ence orientation. They may not prove to each other between different orientations. The concepts of legal person focus on legal rights and obligations in law technically, which also proved assumption of benefit maximization is legitimacy. The concepts of legal person will enhance the study of law.
