室内装修污染及其民事法律救济制度分析

室内装修污染是一种新型污染,在最近几年才受到社会重视,但对于这种新型环境污染赔偿案件,现有法律规定存在诸多难题与空白。如何建立一种更为合理的救济机制是需要考虑的问题。本文从侵权法和契约法的基本理论着手,分析室内装修污染应当承担的侵权损害赔偿责任和违约责任,对我国室内装修污染的民事法律救济机制进行系统全面的论述,初步设计了遭受家装污染后的赔偿标准和装修中环境质量合同的条款,旨在建立一个既具有理论价值,又具有实践可操作性的民事救济制度。

Indoors Decoration Pollution and Its Corresponding Civil Law System Analysis

Indoors decoration pollution is a new type of pollution,it has been paid attention by the society recently,but for the new type of environment pollution case,the current law system has some drawback on it.How to create a more rational law system is the issue for us to consider.This paper is discussed from the basic theory of tort and contract law,analyzed the indoors decoration pollution liability and tort liability,and make a through analysis on our country indoors decoration pollution civil law system,it briefly designed the penalty criterion and the decoration quality agreement,aiming to establish a more practical and theoretical civil law system.
