| 摘 要： | 目前,我国投资领域看似繁荣但问题错综复杂,国民待遇适用的标准混乱已经恶化了我国的投资环境,主要体现在国民待遇与非国民待遇并存,内资待遇标准的不一致,外资上位法与下位法的不一致,外资法与WTO及双边协定的规定不一致等方面.应从调整并理顺内资法律法舰及其政策,统一内资的法律地位和待遇标准;建立统一适用的外资待遇标准,取消对外资的非国民待遇;清理和调整地方性法规及其政策中与WTO和双边投资协定及国家外资法律法规不一致的外资待遇规定;加快制定体系完整、前瞻性强的外国投资法步伐等方面入手,完善我国外资待遇立法及政策.
