| 摘 要： | 宪法适用包括两个层面:宪法诉讼中的宪法适用、合宪性审查中的宪法适用。我国并没有建立起宪法诉讼制度,宪法还不能进入诉讼,初步建立起来的合宪性审查制度并没有得到实施。究其原因,我国的宪法适用存在制度和现实实施上的困境。基于我国政治力量对比关系的现状,我们应采取稳健的方式建立和完善我国的宪法适用制度。

| Abstract: | Our country has not established the constitution lawsuit system, the constitution has not been able to enter the lawsuit, establishes initially gathers the constitution review mechanism not to obtain the implementation. Based on our country political power contrast relations' present situation, we should adopt the steady way to establish and consummate our country's constitution to be suitable the system. |
