| 摘 要： | 我国行政追偿制度建立已有时日,但基本停留在法律层面,现实中没有得到有效执行,其主要原因就是理论研究的相对薄弱.文章通过对中法两国的行政追偿制度的比较,总结出法国的成功经验,结合我国国情,从程序设计、明确抗辩权和提供救济路径等方面提出我国当前应当变革之举,以期促进我国的行政赔偿制度的完善.
