近代银行法的国际化与本土化——兼论当今金融创新法律制度的构架

近代银行法具有两方面的特征。一是基于法律的本质、传统法律的缺失等原因,以移植为立法建制的主要途径,因而在立法思想、法律原则等方面具有显著的＂国际化＂特征;二是移植而建的银行法也根据国情进行了＂本土化＂,在本国银行家的实践中,揉入了行业规则及经验。近代银行法的建立过程生动体现了金融创新与法律变革的互动,为当今金融创新法律制度的构建提供了借鉴,即建立适应金融创新的监管法律制度,加强金融国际合作立法与国内法的转化,并针对金融创新成果及时立法,防范风险。

On the Internationalization and Localization of Legislation of Banking in Modern Chinese History——Also on the Current Framework of the Legal System of Financial Innovation

The modern banking law carried out the characteristics of internationalization and localization which is due to the essence of law,the absence of traditional law.Transplantation has been used as the major avenue to legislation organizational system;therefore it demonstrates the internationalization characteristic on legislative ideologies and legal principles while it shows the localization according to the national situation,which means industry regulations and experiences should be involved into the national banking practice.The process of the Modern Banking Law vividly reflects the interaction of the financial innovation and legal changes,which provides inspirations to the construction of the nowadays financial innovative legal system,establishing the legal system of regulation of financial innovation,strengthening transformation of the international financial legislation into domestic law,and promptly legislating the system of financial innovation against financial risks.
