中国传统文化中的＂群体本位＂思想主要根源于儒家思想以及小农经济的长期存在,它是现阶段我们建设法治社会的不利因素之一。现代法律理念与＂传统人＂的背离和张力,是困扰转型国家法治进程的一个严重的突出的问题。因此,光是简单移植和建立完备的法律制度、法律规范体系,并不能必然地带来法治,而主体因素则是至关重要的。

Chinese traditional culture in the "community standard" thought mainly rooted in Confucianism and the persistence of small-scale peasant economy,it is one of the disadvantages of the present stage,we build a rule of law society.Modern legal idea and "traditional" divergence and tension,beset in transition process of rule of law is one of the major outstanding issues.Therefore,just the simple transplantation and the establishment of a comprehensive legal regime,the system of legal norms,does not necessarily bring about the rule of law,and the main factor is crucial.
