经济全球化背景下的居民环境权的交易与保护

文章以居民环境权与环境治理关系为研究对象,分析了居民在西方环境治理中的角色及贡献,概括分析了我国企业与居民环境利益冲突问题,揭示了居民环境权益主体利益缺失和环境权没有得到足够的重视和保护等导致环境污染的制度根源,提出了重视居民环境权交易与保护的若干政策建议。

The Exchange and Protection of the Civil Right of Environment in the Economic Globalization

This article studies the civil right of environment and its relationship with the governance of environment, analyzes the role that the citizens play in the governance in western countries. It concludes that due to the lack of entity benefit in business sectors and citizens,and that the right of environment has not been paid enough attention, the environment pollution is caused by these institutional roots. This article also provides the suggestions on how to concern the exchange and protect the right of environment.
