| 摘 要： | 强制拆迁所引发的社会矛盾已成为一个倍受社会关注的热点问题.现行城市拆迁中强制拆迁制度在程序上存在不合理.实体上存在缺陷.强制拆迁制度的重构必须强制执行司法化、确立强制拆迁的程序机制、确立公共利益听证制度、健全补偿和评估制度、正确定位政府角色.

| Abstract: | The social conflicts caused by forced building demolition has become a popular hot issue of social concern.The forced building demolition system existing the present urban relocation is lack of justice in respect of substantiality and procedure.The reconstruction of it must be judicial enforcement,establish procedures mechanism for the forced building demolition,establish the public interest hearing system,perfect compensation and appraisal system and locate government role correctly. |
