论我国侦查启动模式的重构

我国现行刑事诉讼法将立案规定为侦查的启动程序,不仅不能达到限制侦查权力滥用的目的,而且还会降低侦查效率,阻碍刑事案件的输入。侦查部门提出的＂初查＂、＂立线侦查＂等理论只是想从操作层面对现行侦查启动模式行改良。而要想从根本上解决问题,必须要从立法上明确我国侦查的随机型启动模式;并将侦查划分为初步侦查和后续侦查两个阶段;将立案作为这两个阶段的分界点;同时通过对侦查行为进行具体分类和严格程序限制来确保侦查权力不被滥用。

On the Reconstruction of Initiation Mode of Criminal Investigation

In China,file case is the first and necessary step of criminal investigation.But the facts show it can＇t reach the target protecting human rights and cracking down on committing a crime.The theories such as ＂preliminary investigation＂ and ＂random to investigate＂ are wants to solve this problem.The paper proposes that the initiation of criminal investigation ought to adopt a random mode.Investigate process can be divided into two stages： for the first step investigates and follow-up investigate.And placing a case on file for investigation and prosecution procedure is the separation between these two stages.Meanwhile,classifying investigation behavior and restricting the procedure can be used to avoid the misuse of the investigation right.
