| 摘 要： | 在现代的国际贸易中,一系列自动化交易系统大大简化了交易程序,提高了交易效率,这些自动化、智能化的交易程序即为电子代理人。目前,电子代理人对国际贸易的影响日渐凸现,并由于其介入也引发了一些法律问题。依据民商法、对外贸易法的理论及现行法律规定、联合国以及各主要国家立法关于电子代理人的规定外贸电子代理人不具有独立的缔约能力。

| Abstract: | E-agent,or electronic agent,refers to the automatic and intelligent dealing procedures that are employed in modern international trades.They greatly simplify the trading procedure and improve its efficiency.Nowadays,its impact on the international trade is getting large and trigger some legal problems.Therefore,this paper attempts to analyze the contracting capacity of e-agent of foreign trade in terms of such laws and regulations as Civil Commercial Law,Foreign Trade Law,and some current legal regulations of the United Nations,and the major industrialized powers' legislation. |
