论集体林权制度改革中的林权流转制度

通过对林权流转含义的辨析和法律政策依据的分析,研究了林权流转与集体林权制度改革的关系。研究结果表明:中国林权流转存在法律依据不明确,林业资产评估手段落后,中介组织不发达等问题。因此,集体林权制度改革向纵深推进要求制定相关法规,为林权流转提供明确的法律依据,促进林业资产评估,培植林权流转中介组织,同时实行政府的适度引导,以促进林权流转规范有序发展。

On the Forestry Right Transfer in the Reformation of Collective Forestry Right System

Through analysis of meanings and legislative authority of forestry right transfer,the research studied the relationship between forestry right transfer and the reformation of collective forestry right system.The problems of forestry right transfer in China conclude: the legal foundation is not clear,the measure of forestry asset evaluation is outdated,and the intermediary organizations are underdeveloped.Hence,it is necessary to establish statutes to provide legal foundation for forestry right transfer.It is important to hasten forestry asset evaluation and to foster intermediary organizations.
