关于完善我国旅行社法律法规体系的思考——兼与日本旅行业的比较

通过对中日两国旅行杜法律、法规的产生背景、法律层次及具体条文进行比较,我国旅行社的发展,政府行政主管部门应定位于宏观调控,从以行政管理为主向法制化、规范化行业管理的转变。并制定符合中国国情的法律法规,以促进我国旅行杜快速发展。

A Study on Perfecting the Laws and Regulations ofr Travel Agency in China --Comparing with the Travel Agency in Japan

By contrasting Chinese and Japanese travel agency in terms of fromative background of law and regulation, the legal level and concrete clause, the paper expounds the development of the travel agency.It suggests that the leading administrative department of government should adopt macroscopic adjustment and control, and make it the main way to manage the travel agency, then develop it as legalised and normalized.At the same time, the laws which correspond with the situation of our country should be made to prompt the development of tourism industry.
