论探矿权退出机制的法律完善--从公告注销勘查许可证的进路

我国已经建立起多元化的探矿权退出机制，在实践中，管理部门公告注销勘查许可证在探矿权退出中所占比例高达60%。但管理部门公告注销勘查许可证，仅在《行政许可法》中有相关规定。为了进一步完善探矿权退出机制，提高公告注销勘查许可证操作的规范性，使得矿产资源能够得到更充分的开发利用，应当通过《矿产资源法》修改明确公告注销勘查许可证制度。

Discussion on the Law Improvement with regard to Exit Mechanism of Mineral Exploration Rights-The Approach to Announcement of Mineral Exploration Licence Cancellation

Diversiifed exit mechanisms of mineral exploration rights have been set up in China. Announcement of mineral exploration licence cancellation by the management department represents 60% of the exit of mineral exploration rights, but some concerned stipulations are provided only in Administrative Licensing Law. This paper argues that in order to improve the exit mechanism of mineral exploration rights and the standardization of operation of announcement of mineral exploration licence cancellation, as well as make mineral resources get a better development and utilization, we should deifne the system of announcement of mineral exploration licence cancellation in the revision to Mineral Resources Law.
