| 摘 要： | 代位继承制度是继承法的重要制度之一,是保护公民私人财产顺利转移的重要法律依据。现实中,我国代位继承制度由于采用"代表权说",存在较多的问题。随着社会实践的发展和立法技术的提升,有必要对我国的代位继承制度进行改进和完善,以适应时代发展需要,实现公民的私人财产继承权得到足够的保护。
