反垄断法:基于法经济学视角的解析

竞争是市场经济的本质属性和基本特征,发展市场经济不能不竞争又不能乱竞争。垄断的实质是限制价格在市场经济中合理调节生产和优化配置资源的功能,违背了法律的基本价值——自由、效率和公共利益的要求。反垄断法的价值目标是维护市场机制的正常运转,有效发挥其优化配置资源的功能,提高社会总体福利,保护公共利益。反垄断法和反不正当竞争法相辅相成,我国制定《反垄断法》的主要目的是通过对竞争的维护有效发挥市场机制优化配置资源的功能,提高社会总体福利。
