森林资源产权制度研究

一直以来我国实务界和理论界都只重视森林资源作为生态资源所具有的社会意义,强调对森林资源的管理控制,而忽视了森林资源作为一项财产所应具有的私法属性。目前,森林资源产权制度构建作为林业经济运行的基础及林业制度改革的重中之重,尚存在诸多不适应生产力发展的严重问题,森林资源分类管理、保障非公有制经济主体权益、改革公有制林业企业产权制度,是我国发展现代林业必须首先解决的问题。

On Forest Resource Property Relations

Both the circles of practice of China and theory circle,have all only paid attention to the fact all the time that forest resource has some social effects as ecological resources,emphasize the control over forest reserves,and have ignored the private law attribute that the forest reserves should be as a property.With further forestry development of modernization and to realize sustainable development of forestry,forestry has already been in agenda in economic marketization.At present,forest reserves property relations construction is the most important thing reformed as the foundation of forestry economical operation and forestry system,a great deal of incompatibility productivity development still exists.The paper holds that how to classify and manage forest reserves,ensure non-public economic subject benefit,reform public-owned forestry enterprise's property relations,is the problem that modern forestry must solve at first.
