| 摘 要： | 对于楼花按揭抵押是否具有物的担保效力问题,现行《担保法》及其解释尚未明确,在理论上和法律适用中均存在很大争议。文章针对该情况提出自己的观点,认为将按揭房屋抵押视为物的担保,并以该性质适用相应法律,符合有关法律精神和客观情况,利于保证法律规则在适用上的统一,并有助公平解决实际纠纷。
