| 摘 要： | 保险资金运用是现代保险业的核心业务,刑法作为一切社会秩序的最后保障法,对违规运用保险资金的犯罪行为进行调整是十分必要的,我国政府对保险资金运用的刑法保护十分薄弱,必须在监控体系、定罪、刑事处罚和诉讼程序方面进行完善,以规范保险资金运用,保障保险利益相关人的利益.

| Abstract: | The usage of insurance funds is core business of the modern insurance industry, the adjustment to criminal offence for violation of using insurance funds is very necessary by criminal law as a final safeguard of all social order. The penal protection of the usage of insurance funds is quite weak in our government. It must be perfected from the aspects of supervision system, sentence, penal sanction and proceeding to regulate the usage of insurance funds and guarantee the related person's benefits of the insurance benefits. |
