| 摘 要： | 侵权责任与违约责任作为医疗损害赔偿责任的现实形态,其运用往往依个案的不同而有所取舍,请求权是可以选择的,而法律适用通常不能选择。在经济赔偿方面,无论医疗损害责任承担方式如何选取,都要紧紧把握经济赔偿额与责任主体的责任程度、患者的病损程度以及医疗事故等级相适应的基本原则,从而最终实现医患关系的和谐互动。
