| 摘 要： | 必然性是或然性的一极,只有作为或然性才能得以表现。由于在侦查活动中侦查员思维的灵活性和新颖性,侦查领域中的演绎推理本身大、小前提的不必然为真以及推理形式的多样性等性质和特点,决定了侦查演绎推理的结论往往只充满着必然性的价值意愿,大量表现出来的,却是或然性的现实存在,这就是侦查演绎逻辑的哲学背景。
