中国征地制度改革:基于网络治理的途径

研究目的:探索中国征地制度存在问题的根源,提出改革建议。研究方法:实地调查法,文献研究法和比较分析法。研究结果:中国征地制度实施中出现的诸多问题与制度中的相关利益主体有密切关系,利益主体之间的互动模式和利益取向导致了问题的产生。研究结论:解决征地制度中的问题需要厘清制度的网络结构,借助网络治理手段调整网络关系,培育网络间的协调与合作机制,使得制度参与方在互动与沟通中达成共识。这种基于共识的政策参与形式能为制度的实施扫清障碍,并在互动与合作中走向共赢。

Reform of Land Expropriation System in China: The Way Based on Network Governing

The purpose of this paper is to explore the essence of current problems in land expropriation system in China so as to put forward reform proposals. Methods employed include field survey, documentation and comparative analysis. The results indicate that there is a close relation between occurred problems of the land expropriation system and the interest-related parties within the system, i.e., the mode of interaction and the aim of benefit amongst the interest-related parties are the causes of problems. It is concluded that via three aspects of efforts, problems in land expropriation system could be solved, such as making clear of the network structure of the system, adjusting the network relationship through network governing, cultivating the mechanism of coordination and cooperation in the network, which can accelerate the consensus of the participants in the system through interaction and communication. It is argued that only this kind of policy participation based on consensus can remove the obstacles and barriers of the system and achieve a win-win situation during interaction and cooperation.
