关于宪法财产权保护的几个问题

我国现行宪法在确认现阶段基本经济制度的同时，认可了现存的各种所有制经济在宪法中的不同地位，并进而对与各自所有制经济相对应的财产权，规定了保护力度不等的差序保护即不平等保护。在现实中，这种厚此薄彼的取向，既缺乏充分的事实依据，也缺乏充分的法理依据，既不利于对公共财产的保护，也不利于对私人财产的保护。实际上，当下中国，非国有经济应当比国有经济更多地得到宪法的保护。
