我国专利默示许可制度构建

由于现有制度并不能解决司法实务中面临的所有问题,因此在我国进行专利默示许可制度构建势在必行。分析指出,我国应首先完善《民法总则》中与专利默示许可相关的基础性规定,并在《专利法》中对具有普遍意义的特定情形下的专利默示许可进行明文规定。同时,应明确专利默示许可规则的确立与TRIPS协议的基本要求并不冲突。

Construction of Patent Implied License System in China

There is imperious demand for the patent implied license system to the judicial practice in our country. However, the existing system cannot solve all the problems faced in the practice. Therefore, it is imperative for our country to establish the patent implied license system. As far as the specific legislation, the basic provisions in the General Principles of Civil Law which related to the patent implied license should be first perfected. And only the typical patented implied license can be raised to legal requirements which have universal significance in the Patent Law. Meanwhile, it should be clear that there is no conflict between the establishment of patent implied license rules in Patent Law and the basic requirements of TRIPS agreement.
