商标的异化与商标权限制的现代发展

随着商品经济的发展，商标开始异化，传统商标法构筑的利益平衡被打破。该文从商标的异化出发，分析了商标异化的表现，然后针对因商标异化引发的商标权扩张和商标权限制的此消彼长，研究了商标权和商标权限制。

Trademarks Dissimilation and Modern Development of Restrictions on Trademarks Rights

With the development of commodity economy, trademarks are dissimilating. The benefit balance con- stmcted by the traditional trademark law has been broken. Based on the trademarks dissimilation, this paper first ana- lyzes its manifestations, and then, with regard to the balance of trademarks right expansion and restriction, researches into the trademark rights and the modem development of restrictions on trademarks right.
