| 摘 要： | 改革开放２０年来，中国已初步建立了比较独立的涉外投资法律体系，但它存在法律体系和结构不合理、法制环境欠佳、部分内容不合时宜等问题， 因而有必要完善涉外投资政策法规， 主要对策有： 制定统一的《外商投资法》和独立的《海外投资法》；按ＴＲＩＭｓ等国际通行规则调整法规的部分内容；强化涉外投资法制环境的建设。总之， 与国际惯例逐步接轨是必然趋势

| Abstract: | Since 1979,China has established an initial foreign investment legal system.But many problems still exist,for instence,in the structure of the laws,the legal environment and some contents of the laws.So the foreign investment policies and laws must be perfected.First,we must draw up an unified foreign investment law.Second,some contents of the laws must be modified according to TRIMs. Third,we must strengthen the construction of the legal enviroment.In short,we should learn from the international practices. |
