| 摘 要： | 土地是农村最基本的生产资料。联产承包责任制的推行，为土地使用权的流转创造了前提条件。《农村土地承包法》的实施，为土地使用权的流转提供了法律依据。由于受诸多因素的影响，我国农村土地使用权的流转出现了严重的异化现象。因此，加强农村土地使用权流转的法律制度建设，引导、完善、规范农村土地使用权的合理流转，是摆在我们面前的一项重大课题。

| Abstract: | The land is the most fundamental means of production in the countryside. The join contract system creates the prior conditions for the circulating and transferring of use right. The implementation of land contract law provides the law basis for the circulating and transfer of use right. Because of the influence of many factors, there appears to be serious alienation phenomenon in the circulating and transfer of use right. Therefore, it is an important task for us to enhance reasonable law system for circulating and transferring of use right, lead, perfect and regulate the usage of land. |
