论必要航空服务原则在中国空运管理制度之适用

摘    要:必要航空服务原则起源于美国,后被各航空发达国家广泛采用。该原则适合中国国情,能合理调适开放民航市场与确保国内航线正常平稳发展的潜在冲突,对完善航空管理制度,平衡国家、航空公司以及乘客各方之利益将起到积极作用。但政府对航空公司之经济援助应受到一定限制,否则会对航空业造成过度干预,从而导致不公平竞争。必要航空服务原则的适用,要求完善我国的航线网络,并对我国航空管理法律制度产生诸多深刻的影响。

Abstract:Air transport regulation is one of the most important topics so far as the aviation sector is concerned. Essential air service principle can rectify the possible defects arising from the opening of aviation market. At the same time, the author attempts to examine the possible problems arising from the implementation of such principle and its effects on the existing legislation regarding air traffic regulation. The author hopes that this paper can, on one hand, make up for the loopholes or insufficiencies of the existing research of the Chinese scholars in this area and,on the other hand,can be regarded as a reference for civil aviation reforms in the future.
