| 摘 要： | 本文以轮胎特保案为例，从国际法规则、美国国内法和调查实践出发，比较了一般保障措施和特保措施实施条件规定的差异，反映了对外贸易中我国产品现实的国际法治环境，针对2008年金融危机爆发后抬头的贸易保护主义，从法律、政治外交和产业结构调整等方面，提出反思和应对策略。

| Abstract: | The case of special safeguard on Sino-US tires has been brought into focus. Looking into the rules of international law with U.S, domestic law and the practice of the investigation, we aim the outbreak of financial crisis and the rise of trade protectionism put forward some strategies in law, policy and industrial restructuring. |
