| 摘 要： | 业主委员会的法律地位立法应明确规定,承认其为非法人团体能为业主委员会具有诉讼主体资格提供理论支持。但其中由业主承担连带责任的风险应通过业主委员会及其成员的民事责任制度和监督制度予以控制。

| Abstract: | The legal status of the homeowner’s association should be stipulated clearly. While the homeowner’ s association was confessed as an non-corproate body, It would have the qualication of litigator theoretical ly.However,the risk of joint responsibility shared by the homeowner should be controlled by the civil responsibility and supervision institution of the homeowner’s association and its members. |
