摘    要:劳动者的工资权是劳动权的核心内容,也是劳动行为追求的终极目的。现阶段我国农民工工资仍然存在诸如工资水平普遍偏低、拖欠和随意克扣工资现象依然存在、加班加点工资严重缺失等方面的问题。基本人权的保障、社会的发展和弱势群体的关注需要国家对农民工工资权予以法律保障。要确实保障我国农民工工资权就必须制定《工资支付法》、建立欠薪保障制度、加强劳动保障监察机制、发挥工会组织维权机制、增设恶意欠薪刑事责任。

On China farmer labor salary right’s legal protection
Abstract:Worker’s wages right is the central content to working right,and it’s also the ultimate goal of working behavior pursuit. Nowadays peasant workers' wages still exists some problems, such as universally low wage level, defaulting and deducting wages, no overtime wages and so on. With the guarantee of fundamental human rights, the development of society and the attention for weak colony, peasant workers’ wages right need legal guarantee needs. Therefore, we should work out "Wages Payment Law", build guarantee system of defaulting wage, strengthen supervision mechanism of labor guarantee, exert protecting mechanism of labor union organization and add legal responsibility of evil defaulting wage to guarantee the right of peasant workers wage.
