内部性及其治理机制:基于产权视角的分析

本文从产权的视角分析内部性的产生及其治理机制。内部性可以分为内部性Ⅰ和内部性Ⅱ。内部性Ⅰ是交易过程中,交易者自发攫取公共领域里的租金,没有引起争夺产权的冲突,达到产权博弈均衡时的内部性。内部性Ⅱ是契约执行过程中,因交易者对公共领域里财富的预期价值提高或对公共领域财富确立排他性产权的费用下降,产生了争夺产权的冲突,产权博弈非均衡时的内部性。内部性Ⅰ是无法避免的。内部性Ⅱ既可通过自由谈判和法庭裁决在事后治理,还可依赖政府社会性规制在事前或事中加以防范。这两种性质不同的治理机制可以起到一定的互补作用。但是政府社会性规制存在的缺陷也是显而易见。

Inner characteristics and its governance mechanism: analysis base on equity vie wpoint

This paper analyzes the produce of internalities and its gov- ernance mechanisms from the perspective of property rights. Internalities can be divided into internality land internlity Ⅱ. The internality Iis in the transaction process, the dealers spontaneously seize the rent in the public domain but there is not any property conflict when achieving property right gambling equilibrium. The internality Ⅱis in the transaction implememta- tion,the dealers conflict when they capture the rent in the publicdomain. We can resolve the intern.alities llthrough negotiations and court, or relying on the government regulations. These two different governance mechanisms can play very good complementary roles. However, there are some obvious defects in the government regulations.
