| 摘 要： | 海峡两岸金融合作日益活跃,民间借贷活动日益成为正规金融活动的重要补充,但鉴于民间借贷在规范性、风险控制、社会稳定性等方面存在不足,因此需要对民间借贷进行司法监管。本文在深入探讨民间借贷及其司法监管内涵,以及考察海峡两岸民间借贷监管的历史的基础上,针对海峡两岸民间借贷司法监管机制存在的诸多问题,提出了构建海峡两岸民间借贷司法监管机制的设想。
