摘    要:以房养老服务合同是指达到一定年龄的老年人,以自有房屋为限与金融机构签订反向抵押养老的协议。最早源于荷兰,我国近年在北京、南京等地试点。该合同的主体涉及老年人、金融机构(包括商业银行、保险公司等)、养老服务提供机构等多方主体,老年人既是接受养老服务的主体,同时也是以房换取养老服务的抵押主体;抵押权人是金融机构;提供养老服务方是养老机构,前两类主体具有一定的特殊性。房屋是换取养老服务的对价,因城镇与农村的不同,房屋的样态及其规范有别。

Abstract:House-fnr-pension service contract refers to the agreement made by the aged and financial institution on condition that the aged raise a reverse mortgage on a house from financial institution. The practice originated from Holland. Recently, China has launched a pilot project in Peking, Nanjing, etc. The subjects of contract deal with the aged, finaneial institution( including commercial bank, insurance company, etc. ) , and service provider. The aged are not only the subjects accepting service, but also the mortgage subjects in return for service. The mortgagee is financial institution. The service provider is nursing institution for the aged. The first two kinds of subjects have some particularities. The house is in return for service. The types of houses and specifications are different in urban and rural areas.
