| 摘 要： | 司马光的礼法互补、德刑并用的思想是建立在“性善恶混”的人性论基础上的。他提出了许多可贵的法制思想，如法制应该简要、稳定，统治者要知法、守法、赏罚分明。不过，司马光把法制当作统治工具看待，法的本质是刑罚，这与现代法治观念尚有很大差距。

| Abstract: | Sima Guang＇ s thought of legal system was based on the theory of human nature in which there are good and evil. He put forward a number of valuable ideas ： the legal system should be brief and stable ; the rulers must understand and abide by the law; and the rulers must be strict and fair in meting out rewards and punishments. However, Sima Guang regarded the law as a tool of role, whose essence is penalty. There is still a big gap between Sima Guang＇ s thought and modem concept. |
