版权平行进口立法取向的经济学分析

在国际版权贸易实务中,各国因从法学视角对版权平行进口合法性的规定不尽相同,从而引发的争议和纠纷层出不穷,严重影响了各国版权贸易的深入发展。对此,文章运用经济学分析方法来研究版权平行进口的立法取向问题,再通过理性选择理论加以判定,以期平衡各权益主体利益、实现整个社会福利的最大化,最后针对我国版权平行进口的法律规定提出具体的立法建议。

Economic Analysis on Legislation Orientation of Parallel Importation of Copyright

In the post economic crisis era,many countries nowadays have shifted their attentions to trades in culture and intellectual property in order to promote their domestic economic development.Copyright trade as an important ar-ea of cultural trade has got more and more attention.However,different coun-tries have their own different provisions in the international copyright of trade practices,which leads to ceaseless disputes and wrangles and therefore hinders the further development of the international trades in culture and intellectual prop-erty.Based on this situation,by the way of economic analysis and according to the theory of rational choice,we should go after maximizing social welfare un-der the premise of balancing the benefits of all participants.According to the law of parallel import of copyright commodity,the paper provides detailed legisla-tive suggestions.
