反假冒贸易协议与我国知识产权执法机制改革

以加强国际知识产权执法为主要内容的《反假冒贸易协议》最终文本已于2010年12月3日公布。围绕该协议的公布,新的国际知识产权保护规则或许即将确立,从而引发更多的知识产权贸易壁垒。为有效应对新一轮知识产权贸易大战,我国必须及时改革现行知识产权执法"双轨制",合理配置知识产权行政机关职能,完善知识产权司法保护制度,加强网络知识产权执法,加强执法跟踪与透明化,加强国际层面的执法合作,完善知识产权执法评估方式。

Anti fake commodity trade agreement and China intellectual property right enforcement mechanism reform

With the main content of strengthening international intellectual property rights enforcement,the ultimate edition of Anti-Counterfeiting Trade Agreement has been announced at December 3rd,2010.Centering on the announcement of this agreement,the new protective rules of international intellectual property rights maybe will be established at once,which will arouse more barriers of international intellectual property rights.To make an effective reaction of the new war of intellectual property rights trade,our country must reform the recent Duo System of intellectual property rights enforcement immediately,arrange the administrative mechanized function of intellectual property rights reasonably,consummate the protective justice system of intellectual property rights,enhance the internet intellectual property rights enforcement,strengthen enforcement supervision and enforcement transparency,strengthen international enforcement cooperation,consummate the evaluated patterns of intellectual property rights enforcement.
