论善意取得制度

善意取得是所有权取得的一种方式,己为大多数国家民法所确认,是物权法上的一项重要制度。善意取得制度创设的目的是保护交易安全。善意取得的构成要件包括:受让人取得财产时出于善意;转让人必须为无权处分财产的人;受让人须通过交易性质的法律行为有偿取得财产;善意取得的财产主要是动产。目前,我国正在构建新物权法,作为现代民法物权的一项重要制度,适当扩大善意取得制度的适用范围是符合法律价值趋向的。
