The Necessity of Generation of the Prohibitive Legal Norms

This article traces the nessessity of prohabitive legal norms to the basis of human nature,argues that it is the feature of human nature determines the nessessity of prohanbitive norms.The machanism of normative order construction of human being experiences a great transform from suppressing human natural requirements to recognizing them and regard them as the basis of making order.So prohibitive norms are the origination of human order and has the priority to other sorts of norms.Under such premise,we think that the unity of duties an rights is as well as the combination of fulfilling duties and leading a happy life,which makes a steady and harmony order possible.
