我国离岸金融的监管与立法研究

离岸金融的发展对我国的金融改革开放具有重要作用,但离岸金融的风险伴随着离岸金融的迅速发展在孕育.我国离岸金融市场发展初期宜先采用内外分离型,监管当局要重视离岸金融风险的管理并采取切实有效的严格监管,尤其要加强离岸金融法制建设.要明确离岸银行管理法规的适用对象、明确离岸银行准入的条件、明确规定预警制度和协调保密与反洗钱的规定等.

The development of offshore finance is very important to Chinese financial reform and opening,but the risk in offshore finance gestates with the quick development of offshore finance.The model of interior and exterior separation should be adopted at the outset of Chinese offshore finance development,and supervision authorities should attach importance to the management,take effective monitoring measures,and especially strengthen the legal system construction of offshore finance.The application objects of offshore bank management laws and regulations should be darified,the entrance conditions of offshore banks should be darified and the provisions on early warning system,coordination and security,and antilaundering should be darified.
