| 摘 要： | 在《担保法》中禁止重复抵押有失科学性 ,设置提前清偿制度也不尽合理。完善我国抵押权立法应规定抵押权行使的除斥期间 ,并设置抵押合同的担保期限。

On the Perfection of Legislation of Mortgage in our Country |

| Abstract: | In guarantee law,the ban of repeating mortgage is unscientific and the establishment of liquidation before expiration is unreasonable.To perfect our legislation of mortgage,we should regulate the scheduled period of carrying out the right to mortgage and set up the period of mortgage of mortgage contract. |
