| 摘 要： | 现行农地制度混同了农村社区组织和农村集体经济组织,在正义和效率两方面都造成了负面影响,其深层次利益动因是国家通过其基层代理人--社区组织替代集体经济组织行使土地所有权从而获取制度收益.重塑农地集体所有权主体的实质是以增进农地使用效率和满足农民的土地利益诉求为目标的制度变迁.新的制度安排的核心内容是:使农民成为农地的终极主体,农村集体经济组织成为农民的直接主体,两者通过产权联系构成一个复合主体系统.
