森林资产流转法律制度研究

以中国现行森林资产流转法律制度为研究对象,对资源管理法(公法)模式,民法(私法)模式,混合(公法为主,私法为辅或私法为主,公法为辅)模式进行分析,指出不同制度模式下对森林多种价值调整的不平衡性导致森林保护法律制度功能的弱化,提出在对森林资源按其功能、经营目的划分成不同森林类型的基础上,再按不同功能的森林分别采取公法(保障),私法(激励)的方式构建法律制度,方能实现法律制度对森林资产流转调整的理想目标。

Analysis on Legal System of Forestry Asset Circulation

The article analyzes legal system of forestry asset circulation.It focuses on model of natural resources administration law(public law),model of civil law(private law),and the mixed model(which is mainly based on public law and supplemented with private law,and vice versa).Then,the article pointed out the function of Forestry Law is weakened due to the imbalance between each models value appeal.To establish the legal system that best regulate the forestry asset circulation,the article proposed that forestry resource should be classified not only according to the function and goal of management,but also to the way of public law(for protection)and civil law(for stimulation).If that,the ideal goal to adjust the circulation of forestry asset by legal system can be realized.
